1. Introduction

Welcome to Hestia Creative. These Terms and Conditions govern your use of our services and your subscription with us. By subscribing or using our services, you agree to these Terms.

2. Services Provided

We provide:

• Website design and development

• Ongoing hosting and maintenance

• Monthly subscription packages (Starter, Growth, Pro and custom Marketing solutions)

Each plan includes one off fees and features as described on our website. Major development requests outside your plan’s scope may require a custom quotation.

3.  Payments

• 50% Payment is required upon project start. Monthly management fees are billed monthly in advance via Paystack.

• You may cancel your monthly management with 30 days’ written notice.

• You may also transfer your domain or move your website to another provider after the project is complete and full payment has been received. 

4. User Responsibilities

By using our services, you agree to:

• Provide accurate and lawful content (text, images, logos, media).

• Secure appropriate licenses and permissions for all submitted content.

• Not use our services for unlawful, harmful, or infringing activities.

5. Intellectual Property

• Website designs and code created by us remain our property until full payment is received. 

• Ownership of the final website passes to you (excluding third-party plugins, integrations, and systems, which remain subject to their own licenses).

• You may not copy, resell, or distribute our proprietary tools without written permission.

6. Maintenance & Support

• Maintenance and support services are included as per your chosen plan.

• Covered: bugs, edits, and uptime monitoring (depending on package).

• Not covered: major redesigns, large new features, or out-of-scope requests (these will be quoted separately).

7. Limitation of Liability

We are not liable for:

• Events outside our control (e.g., natural disasters, power grid failures, or global outages).

• Loss of profits, indirect damages, or data loss.

8. Termination

• We may suspend or terminate your services if you breach these Terms.

9. Refund Policy

• All payments for services rendered by HESTIA CREATIVE (PTY) LTD are non-refundable, except as required by applicable law.
• Fees are considered earned on receipt or when the service begins, as applicable, and are non-refundable for any portion of services not yet delivered.
• If a dispute arises regarding charges, please contact us at info@hestiacreative.co.za to review the specific circumstances. We strive to resolve issues promptly, and any refunds will be considered only where required by law or at our sole discretion.
• In the event of termination of services by us due to material breach of the engagement terms by Hestia Creative, refunds may be considered on a case-by-case basis, at our sole discretion.
